Terms of Service - RecepticoAI

These Terms of Service ("Terms") govern your use of RecepticoAI ("Service"), operated by RecepticoAI ("Company," "we," "us"). By subscribing to the Service, you agree to these Terms.

1. Service Description

RecepticoAI provides an AI-powered phone answering service that handles inbound calls, captures leads, and books appointments on behalf of your business. The Service includes call recording, transcription, and summary delivery via SMS and email.

2. Subscription & Payment

Service plans are billed monthly. A one-time setup fee of $497 is charged at signup. Monthly subscription fees are charged on the same day each month. All fees are non-refundable except as described in our 30-Day Guarantee (Section 3).

Payments are processed by Stripe. By providing payment information, you authorize us to charge your payment method for all fees.

3. 30-Day Money-Back Guarantee

If you are not satisfied with the Service within the first 30 days, we will refund your first month's subscription fee. The setup fee is non-refundable. To request a refund, email hello@receptico.com within 30 days of your go-live date.

4. Cancellation

You may cancel your subscription at any time with 30 days written notice. Cancellation does not entitle you to a refund of any prepaid fees. After cancellation, access to the Service will continue through the end of the billing period.

5. Call Recording Compliance

You are solely responsible for complying with all applicable laws regarding call recording in your jurisdiction. Many states require one-party or two-party consent for call recording. By using the Service, you agree to notify callers that their calls may be recorded as required by law.

6. Acceptable Use

You may not use the Service to:

Conduct illegal activities or violate any laws
Harass, defraud, or deceive callers
Violate any third party's rights
Engage in spam, robocalling, or unsolicited telemarketing
Circumvent our technical measures or access systems you are not authorized to use

7. Intellectual Property

RecepticoAI and its licensors own all rights to the Service, including AI models, software, and technology. You own all content you provide, including your call scripts and business information. You grant us a limited license to use your content solely to provide the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECEPTICOAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE PRECEDING THREE MONTHS.

9. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.

10. Indemnification

You agree to indemnify RecepticoAI from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of applicable law.

11. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the state or federal courts located in San Bernardino County, California.

12. Changes to Terms

We may update these Terms at any time. Material changes will be communicated by email 30 days in advance. Continued use of the Service constitutes acceptance of updated Terms.
